Terms of Service

99Fit is provided by STRICS IT GmbH, Florian-Gmainer-Strasse 4, 4240 Freistadt, Austria. By downloading, subscribing to or using 99Fit, you agree to these Terms and the Privacy Policy.

You must be at least 16 years old, legally able to agree, and use the app in accordance with applicable law. If you do not agree, do not use 99Fit.

99Fit requires an active monthly or annual auto-renewing subscription after any offered free trial. The plans, trial length and eligibility, billing period, local price and taxes shown by Apple before confirmation control your purchase. Apple determines introductory-offer eligibility, and a free trial is generally available only once per subscription group.

When an eligible trial ends, it converts to the selected paid plan at the displayed renewal price unless you cancel before the trial ends. Payment is charged to your Apple Account. The subscription renews automatically unless cancelled at least 24 hours before the current trial or billing period ends, and Apple may charge the renewal within the 24 hours before that period ends.

Manage or cancel in your Apple Account subscription settings. Cancelling stops future renewal; access normally continues until the current paid or trial period ends. Deleting the app or your 99Fit cloud account does not cancel the subscription. Apple handles billing and refund requests, without limiting mandatory consumer rights.

99Fit is a tracking and estimation tool, not medical, nutritional or fitness advice. Meal calories, macros, workout calories, expected weight and goal forecasts can be incomplete or wrong. Review entries and use your judgment; do not rely on an estimate for a safety-critical decision.

Rapid weight loss, fasting and very low calorie targets can be dangerous. Consult a physician or another qualified professional before aggressive weight loss, major diet changes or exercise if you have a medical condition, take medication, are pregnant, are underweight or are unsure what is safe for you. 99Fit does not replace diagnosis, treatment or professional supervision.

Health features require permissions that you control in iOS. You are responsible for the meals, recipes, photos, weight values and workouts you add, and for checking data before writing it to Apple Health. You may change Health permissions at any time.

Do not submit another person's Health data or other sensitive information without a lawful basis and their permission.

When you request an estimate, food text, recipe ingredients or a resized meal photo is sent through our backend to an AI provider. For photos, 99Fit separately creates a small foreground-cutout thumbnail on your device; the image sent for estimation is a resized JPEG and is not the cutout thumbnail.

AI output is probabilistic and must be reviewed before saving. Do not upload private, sensitive, illegal or rights-infringing material. The Privacy Policy explains the provider processing and cache behaviour in detail.

99Fit may reuse local and shared structured caches so an identical request can be answered without another AI call. Shared cache entries use a one-way request hash and structured nutrition data; they do not store the raw food description, recipe or meal photo. Do not put names, contact details, medical details or other personal information in a food description or recipe.

Foods and meals saved to your local library are prepared for cloud synchronisation as structured templates, including their name, source text, ingredients, serving and nutrition data, locale, source mode and optional small thumbnail. Incomplete templates may be sent to the AI provider for enrichment. Templates remain pending until approved for public search.

You retain your rights in submitted content and grant STRICS IT GmbH a non-exclusive, worldwide, royalty-free licence to host, process, moderate, adapt, anonymise and make approved food information searchable as needed to operate and improve 99Fit. After cloud-account deletion, an approved shared template may remain in anonymised form without your ownership hash or thumbnail.

The rolling 24-hour and 30-day burn rankings are approximate comparisons based on submitted active calories. They are not verified competitions, prize programmes or reasons to exercise beyond safe limits. Rankings can be delayed, unavailable or affected by Health data quality. Manipulated or implausible data may be rejected or excluded.

Do not automate requests, scrape the database, bypass App Check, subscriptions, payment, rate limits or safety controls, share transaction credentials, interfere with the service, reverse engineer protected backend behaviour or use 99Fit to operate an unauthorised competing service.

We may throttle, reject or suspend cloud access where reasonably necessary to prevent fraud, excessive cost, security incidents, legal violations or harm. Limits can vary by feature and may change to preserve service reliability.

99Fit depends on Apple, Google Firebase and Google Cloud, OpenAI and other infrastructure providers. Features, models, estimates, prices, limits and providers may change, fail or be discontinued.

We aim to keep the service available but do not guarantee uninterrupted access, permanent database entries or identical AI output.

You can export and delete cloud data from Profile. Cloud deletion does not remove local app data, Apple Health records or cancel an Apple subscription. Approved shared templates can remain in anonymised form after account deletion, and purchase, security or legal records may be retained as described in the Privacy Policy.

If you use cloud features again after deletion, 99Fit may create a new anonymous account. We may suspend or terminate cloud access for material or repeated violations, security threats or legal requirements.

To the maximum extent permitted by law, 99Fit is provided without guarantees that estimates are accurate or suitable for a particular result. STRICS IT GmbH is not liable for indirect loss, missed goals, decisions based on estimates or misuse of the app.

Nothing in these Terms excludes statutory warranty, withdrawal, health, product, data-protection or consumer rights, or liability that cannot legally be limited.

We may update these Terms for legal, security, provider or product changes. Material changes will be communicated where required, and a new version and effective date will be published.

Austrian law applies without depriving consumers of mandatory protection in their country of residence. Contact STRICS IT GmbH at hello@strics.at.
